This Legal Notice regulates the access, navigation and use of the Website, by means of which we inform the Users about their rights and obligations in relation to the contents shown in it, the logos and trademarks used, as well as the responsibilities that may arise from its use. Access to the Web Site is free of charge except for the cost of the connection through the telecommunications network provided by the access provider contracted by the Users. Notwithstanding the foregoing, NASH21 reserves the right to modify the presentation, configuration and content of the Web Site, as well as this Legal Notice, so Users are recommended to review it constantly. The access and/or use of the Web Site after the entry into force of its modifications or changes implies the acceptance of the same. In this regard, NASH21 is a protocol that offers the user the possibility of tokenizing, guaranteeing and commercializing rental contracts. Supported by a guarantee fund that combines mathematics and cryptography, NASH21 aims to redefine the rental market worldwide, redesigning the old lease contracts and making them now "smarts".
2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
NASH21 is the owner or, if applicable, has the corresponding licenses over the intellectual, industrial, image or any other analogous rights over the Web Site, as well as over all the contents offered therein, including, but not limited to, photographs, illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content included therein. Users only have a non-exclusive right of use, within a strictly personal scope and for the sole purpose of browsing the Website in accordance with this Legal Notice.
3. RULES OF USE OF THE WEB SITE
3.1. It is not permitted, and therefore the consequences will be the sole responsibility of the Users, to access or use the Website for illegal or unauthorized purposes, with or without economic purpose. In particular, and without limitation to this list, it is prohibited to: (i) Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in the operation of these or third party devices; (ii) Use the Web Site for the transmission, installation or publication of any virus, Trojan horse, worm, malicious code or other harmful programs or files or with illicit intentions; (iii) Use the Web Site to transmit material for advertising or promotional purposes, including spam, chain letters, or the like, without NASH21's express prior written permission; (iv) Use the Web Site in a manner that constitutes an infringement of any rights of NASH21 or any third party; (v) Use the Website to transmit or post any material of a defamatory, offensive, racist, vulgar, hateful, denigrating, pornographic, or obscene or threatening nature or that may annoy, harm, or otherwise injure any person in NASH21's sole discretion; (vi) Use the Web Site to collect personal data from other Users; (vii) Use the Web Site illegally, against good faith, morality and/or public order; (viii) Access without authorization to any section of the Web Site, to other systems or networks connected to it, to any NASH21 server or to the services offered through the Web Site by means of hacking or forgery, password extraction or any other illegitimate means or those established in this Legal Notice; (ix) Carrying out any action that causes a disproportionate or unnecessary saturation in the infrastructure of the Web Site or in the systems or networks used or owned by NASH21, as well as in the systems and networks connected to the Web Site. The breach of any of the above obligations by the Users of the Web Site may lead to the adoption by NASH21 of the appropriate measures protected by law and in the exercise of its legitimate interests. 3.2. All the information provided by the User through the forms of the Web Site for the previous purposes or any other must be truthful. For these purposes, the User guarantees the authenticity of all the data provided and will keep the information provided to NASH21 perfectly updated so that it corresponds, at all times, to the real situation of the User. In any case, the User shall be solely responsible for any false or inaccurate statements made and for the damages caused to NASH21 or third parties for the information provided.
4. RESPONSIBILITIES AND GUARANTEES
NASH21 cannot guarantee the reliability, usefulness or accuracy of absolutely all the information contained in the Web Site, nor the usefulness or accuracy of the content made available to Users through the Web Site. Consequently, NASH21 does not guarantee and is not responsible for: (i) The continuity of the contents of the Web Site; (ii) The absence of errors in such contents; (iii) The absence of viruses, Trojans, worms and/or other malicious or technologically harmful components in the Web Site or in the server that provides it; (iv) The invulnerability of the Web Site and/or the impossibility of violating the security measures adopted therein; (v) The lack of usefulness or performance of the contents of the Website; (vi) Failures of the Web Site caused by any type of attack on its servers or those of NASH21's third party service providers, as well as technical or security failures of the system of any of such providers that prevent the correct operation of the Web Site; (vii) Any technical failure of any kind that hinders, delays or prevents the proper functioning of the Website; (viii) Any damage or harm caused, to itself or to a third party, by any person who violates the conditions, rules and instructions that NASH21 establishes in the Web Site or through the violation of the security systems. NASH21 declares that it has taken all necessary measures, within its possibilities and the state of the art, to ensure the operation of the Web Site and to minimize system errors, both from a technical point of view and from the point of view of the contents published on the Web Site. NASH21 shall not be liable for the accuracy, completeness or updating of the information published on the Web Site from external sources, nor for the information contained in other platforms linked to from the Web Site. NASH21 reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, hosting and/or downloading of the content and/or use of services of the Web Site, with or without prior notice, to Users who contravene any of the provisions detailed in this Legal Notice, without the possibility of demanding compensation for this reason.
5. force majeure
Notwithstanding the foregoing, NASH21 shall not be liable for any delays or failures that may occur in the access, functioning and operation of the Web Site, its contents and/or services, nor for any interruptions, suspensions or malfunction of the same, when caused by failures due to any situation of force majeure or fortuitous cause. NASH21 shall not be liable for any failure or delay in the performance of any performance when such failure or delay is due to events beyond its reasonable control ("Force Majeure Cause"). Force Majeure Causes shall include any act, event, failure to exercise, omission or accident beyond NASH21's reasonable control and, among others, the following: (i) Strikes, lockouts or other industrial action; (ii) Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared) or threat or preparation for war; (iii) Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster; (iv) Impossibility of the use of trains, ships, airplanes, motor transport or other means of transportation, public or private; (v) Impossibility of using public or private telecommunications systems; (vi) Acts, decrees, legislation, regulations or restrictions of any government or public authority. It shall be understood that the aforementioned actions shall be suspended during the period in which the Force Majeure Cause continues and NASH21 shall have an extension in the term to comply with the same for a period of time equal to the duration of the Force Majeure Cause. NASH21 will use all reasonable efforts to bring the Force Majeure Event to an end or to find a solution that will allow NASH21 to perform its obligations despite the Force Majeure Event

The Users have at their disposal the service of attention to the User by which NASH21 will attend the consultations, complaints and suggestions raised by them. NASH21 will respond to complaints or queries as soon as possible and, in any case, within a maximum period of one (1) month.
7. CONFIDENTIALITY AND DATA PROTECTION.
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, as well as Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, all personal data provided during the use of the Website will be treated in accordance with the provisions of the Privacy Policy that Users must read and, where appropriate, accept and/or consent to.
8. SAFEGUARD CLAUSE
All the clauses or ends of the present Legal Notice must be interpreted independently, not being affected the rest of the clauses in case that one of them has been declared null by judicial sentence or firm arbitral resolution. The affected clause or clauses shall be replaced by another or others that preserve the effects pursued by this Legal Notice.
9. APPLICABLE LAW AND JURISDICTION
The access and use of the Web Site will be governed and interpreted in accordance with the Spanish common law and, unless otherwise established in the applicable regulations (including the regulations of consumers and users), any conflict will be submitted by the parties to the judges and courts of the capital city of Madrid.
